The child’s mother, 30-year-old Kelsey Hannah, surrendered her son to the Miamsiburg Police Department, Detective Sgt. Jeff Muncy said.
“She is facing an interference with custody charge,” he told WHIO-TV’s James Buechele. “She doesn’t have a criminal history. She got a summons to appear (in court) instead of going to jail today. She brought the child in, which was the most important thing.”
Muncy said the Amber Alert and Endangered Missing Child Advisory, as well as social media, put pressure on her to come in. She met with an attorney and made arrangements to come in, he said.
The case escalated after Hannah did not turn custody over to Phillips’ uncle on Monday.
On Tuesday, the Warren County judge issued stronger language. The judge ordered her to turn over her child. Muncy said he did not get the case until Wednesday and that no one had been able to reach Hannah.
The failed attempts to contact Hannah and the language in the court order indicating the child was “at risk” in his mother’s care prompted the Amber Alert, the detective sergeant said.

Officials have canceled the Amber Alert and now have issued an Endangered Missing Child Advisory for 2-year-old Atticus Phillips.
While it is not an Amber Alert, the child is believed to be in danger.
Phillips is 3 feet tall, 35 pounds and has blond hair and hazel eyes.
He is believed to be with his non-custodial mother Kelsey Hannah, 30, who is 5 feet 7 and 210 pounds with red hair and green eyes. She drives a gold 1999 Chevrolet Tahoe bearing Ohio plate GGJ 3645.
According to earlier reports, Hannah may have fled to other family residences in Montgomery County, Kentucky or Tennessee. Anyone who sees the child, the mother or vehicle is urged to call 911.

According to court records, Atticus Phillips’s paternal uncle on Monday was granted emergency temporary custody.
The paternal grandfather told a judge at that hearing the parent’s home was unlivable, that the home was full of garbage and drugs. The father failed a drug screen for marijuana and pills, and the uncle also suspected the mother, identified as Kelsey Hannah, also was using drugs, according to Warren County court records.
Kelsey Hannah “did entice, take, keep, or harbor a person, a child under the age of 18 from the parent, guardian, or custodian of the person from … Christopher Phillips, the person determined to be the temporary legal guardian of the child by the courts of Warren County,” according to a Miamisburg Municipal Court document filed Wednesday.

A statewide Amber Alert has been issued out of Miamisburg for a child who was abducted from an East Maple Street address on Monday, according to Montgomery County Regional Dispatch.
At approximately 4 p.m. Monday Atticus Phillips, 2, was reportedly abducted from 514 E. Maple St., the sheriff’s office said.
He’s described as white, with blondish brown hair, hazel eyes and is approximately 3 feet tall and 35 to 40 pounds.
Phillips was allegedly abducted by his mother, Kelsey Hannah. She is approximately 5 feet 7 and 210 pounds with red hair and green eyes, according to the dispatch center.
Hannah fled in an unknown direction possibly driving a gold 1999 Chevrolet vehicle bearing Ohio registration GGJ 3645. She may have fled to other family members’ residences in Montgomery County, Kentucky or Tennessee.
The child may be in immediate threat of danger, the sheriff’s office said.
An arrest warrant was issued Wednesday for Kelsey Hannah, according to Miamisburg Municipal Court records. On Monday, Miamisburg police filed a charge of interference of custody, municipal court records show.
Anyone who sees the child, the suspect or vehicle is asked to call 911.
